Cauvery Water Dispute: Supreme Court Examines Backlog Clearance Amid Drought

Key Highlights & Summary

• The Supreme Court questioned Tamil Nadu on how upper-riparian Karnataka could clear a Cauvery water backlog during acute drought and water scarcity conditions.

• Tamil Nadu filed an application highlighting an 11.719 tmc ft shortfall in water releases at Billigundulu, arguing that deficient rainfall severely impacts Samba crop cultivation in the Cauvery delta.

• Tamil Nadu contended that during a distress year, available water must be apportioned proportionately among riparian states rather than placing the entire deficit burden on a lowerriparian state.

• Karnataka highlighted its severe distress, noting that 45 tmc ft out of its 57 tmc ft reservoir storage is strictly required to fulfill drinking water needs for Bengaluru and other urban centers.

• Karnataka pointed out that Tamil Nadu benefits from the impending northeast monsoon to replenish its basins, an advantage upper-riparian Karnataka lacks during drought periods.

• The Division Bench reserved its order, observing that backlogs can realistically be recovered during periods of excess rainfall rather than during acute scarcity.

Essential Definitions

• Upper Riparian and Lower Riparian: Upper riparian refers to states located closer to the river source (Karnataka), while lower riparian refers to states situated downstream along the river flow (Tamil Nadu).

• Distress Year Apportionment: A legal water-sharing mechanism where water deficits caused by poor rainfall are shared proportionately among all basin states based on pre-established quotas.

• TMC FT (Thousand Million Cubic Feet): A standard unit of measurement used in India to quantify large volumes of water storage and river flow capacities.

• Billigundulu: The designated inter-state boundary measuring station located between Karnataka and Tamil Nadu to monitor Cauvery water releases.

Legal and Constitutional Framework

• Article 262 of the Constitution: Empowers Parliament to enact laws for the adjudication of disputes relating to the use, distribution, or control of waters in inter-state rivers and river valleys.

• Inter-State River Water Disputes Act, 1956: Enacted under Article 262, providing the statutory mechanism for setting up water disputes tribunals (e.g., Cauvery Water Disputes Tribunal) to resolve inter-state river conflicts.

• Cauvery Water Management Scheme, 2018: Formulated by the Centre under Supreme Court directions, establishing the Cauvery Water Management Authority (CWMA) and Cauvery Water Regulation Committee (CWRC) to monitor monthly water releases.

Conclusion The Cauvery dispute highlights the operational complexities of inter-state water sharing during climate-induced drought years. Balancing the drinking water security of upper-riparian populations with the agricultural livelihoods of lower-riparian farmers requires robust, transparent distress-sharing formulas administered by statutory authorities.

UPSC Relevance

• GS Paper II (Polity & Governance): Highly relevant for topics on Inter-State River Disputes, Centre-State Relations, Constitutional Provisions (Article 262), Statutory Bodies (CWMA), and Judicial Adjudication of Water Rights.
