• DPIIT: Department for Promotion of Industry and Internal Trade, the central nodal agency tasked with formulating, monitoring, and streamlining India\'s FDI policy. 

• Automatic Route: An entry channel where foreign investors do not require prior approval from the Government of India or the Reserve Bank of India (RBI).  

• Government Route: An entry channel requiring explicit prior authorization from the relevant administrative ministry or department before foreign investment is processed.

 Legal and Constitutional Framework 

• Foreign Exchange Management Act (FEMA), 1999: The primary legal framework regulating cross-border capital transactions, trade balances, and FDI enforcement in India.

 • FEMA Non-Debt Instruments Rules, 2019: Statutory rules framed under FEMA governing equity investments, sectoral caps, and compliance mandates for overseas capital. 

• Constitutional Allocation (Union List): Article 246, Read with Entry 36 (Foreign Exchange) and Entry 41 (Trade and Commerce with foreign countries) of Schedule VII, vests exclusive legislative power in Parliament. 

• PDI Policy Circulars: Consolidated framework updated periodically by DPIIT specifying sector-specific caps, policy conditionalities, and entry routes.
